Introduction
Yardi Systems, Inc. (“Yardi”) is a leading provider of asset and property management software for the real estate industry. Yardi Cloud Services allows businesses to concentrate on their core capabilities while leaving the management of servers, databases, and applications to Yardi’s IT department. Protecting clients’ hosted Property Management Data is important to Yardi. This Safe Harbor Privacy Policy (“Policy”) sets forth the privacy principles that Yardi follows with respect to its clients’ Property Management Data from the European Union (EU) that is hosted in the United States. This Policy applies to Yardi, which acts as an Agent, hosting its clients’ Property Management Data.
Safe Harbor
The European Commission’s Directive on Data Protection went into effect in October of 1998, prohibiting the transfer of personal data to non-European Union countries that did not meet the EU standard for privacy protection. The United States Department of Commerce in consultation with the European Commission developed a set of principles, called “Safe Harbor Principles” in order to ensure that adequate protection be given to personal information transferred from the EU to the United States. As part of our commitment to protect consumer privacy, Yardi adheres to the Safe Harbor Principles.
Scope
This Policy applies to all Property Management Data from the EU that is hosted in the United States by means of Yardi Cloud Services.
Definitions
“Yardi” means Yardi Systems, Inc.
“Yardi Cloud Services” is built on world-class data centers. To achieve full redundancy and minimize risk, Yardi has partnered with carefully selected providers of data center space—such as Savvis and SunGard—to establish multiple sites where Yardi’s expert team of IT professionals host, maintain, and back up client data.
“Property Management Data” means data regarding the leasing and management of assets and real property including occupancy, vacancy, account balances, lease expirations, ledgers, revenue, budgets, expenses, valuations, pricing, and tenant information.
“Agent” means a third party hosting clients’ Property Management Data for use by the client.
Principles
Onward Transfers
Acting as an Agent, Yardi is committed to protecting consumer privacy and will adhere to the Safe Harbor Principles with regards to its clients’ hosted Property Management Data.
Security
Yardi will take reasonable precautions to protect its clients’ Property Management Data in its possession from loss, unauthorized access, disclosure, alteration and destruction. Yardi has appropriate physical and electronic controls to safeguard and secure such Property Management Data. Yardi cannot guarantee the security of information on or transmitted via the internet.
Data Integrity
Yardi will use personal information only in ways that are compatible with the purposes for which it was collected or subsequently authorized by the individual. Yardi will take reasonable steps to ensure that personal information is relevant to its intended use, accurate, complete, and current.
Access
Yardi will provide access for its hosted clients to correct, amend and delete inaccurate Property Management Data. For security purposes, access is granted after identity is verified.
Enforcement
Yardi will periodically review this Policy and verify that it is accurate, implemented, accessible and conforms with other Yardi policies. Any employee that Yardi determines is in violation of this Policy will be subject to disciplinary action up to and including termination of employment.
Amendments
This Policy may be amended from time to time, consistent with the requirements of the Safe Harbor Principles.
